Justice Department updates ADA regulations and standards
Rules updating requirements for state and local governments covered by title II of the Americans with Disabilities Act (ADA) and those for private sector entities subject to title III were released by the Department of Justice (DOJ) on July 26, 2010. The new regulations update ADA standards governing the construction and alteration of facilities covered by the ADA, including places of public accommodation, commercial facilities, and state and local government facilities. Recreational facilities, such as amusement parks, gyms and golf facilities and swimming pools and municipal facilities, such as courtrooms and prisons are now covered by the ADA.
Facilities covered by the ADA have the choice of following either the updated standards or the original standards during the first 18 months. After 18 months, the updated standards will become mandatory.
